1. Introduction
Welcome to Optima Travel & Tours Inc. ("the Company'', “Our”, “We”). You, the user, will be addressed as (“You, Your, Yours”). These terms and conditions govern your use of our services and website. By using our services or accessing our website, you agree to comply with and be bound by these terms and conditions. If you do not agree with any part of these terms and conditions, please refrain from using our services or website.
2. Services Offered
The Company provides travel booking and advisory services, including but not limited to flight reservations, hotel accommodations, transportation bookings, and tour packages via “Third-Party Services”. Our services are subject to availability, and we reserve the right to make changes or modifications at our discretion.
The Company acts as an intermediary between you, the client, and various third-party service providers, including but not limited to airlines, hotels, transportation companies, tour packages and tour operators. This disclaimer is intended to inform you of the limitations of our liability in cases of loss, accident, injury, delay, defect, omission, or irregularity that may occur during your travel arrangements whether by reason of any act, negligence, or default of any third-party company or person engaged in or responsible for providing the services you have booked through us. It is important to note that each ‘third-party service’ provider is responsible for their own services and is subject to their own terms and conditions, contracts of carriage, and policies. The Company is not liable for the actions, omissions, or negligence of these third-party providers.
3. Client Responsibility
You, as the client, are responsible for providing accurate and complete information for bookings and ensuring that all methods of payments and relevant travel documents, such as passports and visas, are valid and up-to-date. The Company is not responsible for any issues arising from incorrect or incomplete information provided by the client.
You, as the client, acknowledge and assume all risks associated with travel, including but not limited to risks related to health, safety, and security. We strongly recommend that you obtain travel insurance to mitigate potential losses or disruptions during your trip.
The Company shall not be liable for any injuries or any damage to you, any client or be subject to any claim, demand, injury, or damages, whatsoever, including without limitation, those damages from acts of passive or active negligence on the part of ‘The Company’, its officers, employees, or agents. You, the client does hereby expressly release and discharge Optima Travel & Tours, INC., from all such claims, demands, injuries, damages, actions or causes of action. You, the Client, acknowledges that he/she has carefully read this paragraph and fully understands that this is a waiver and release of liability.
4. Booking & Payment
a. Booking: The Company will provide a quote for your requested travel services. Bookings are confirmed only upon receipt of full payment or a deposit as specified in your quote.
b. Payment: Payments can be made through various methods as specified by the Company, including credit cards (Visa, Mastercard, AMEX, Diners club), or other approved payment methods. All payments are non-refundable unless otherwise specified in writing. The Company does not hold responsibility of third-party additional fees in any regards (cancelation, flight or schedule change, missed flights and other).
5. Cancellations & Changes
The Company is not responsible for any changes, cancellations, or disruptions in your travel plans caused by third-party providers. Any changes or cancellations may be subject to the policies and terms of the third-party providers.By using our services or website, you acknowledge that you have read, understood, and agree to these Payment, Refund, and Cancellation Policies as part of the overall Terms and Conditions.
a. Cancellations: The cancellation policies for each booking may vary and will be provided to you at the time of booking. You are responsible for any cancellation fees or charges incurred.
b. Changes: Changes to your travel itinerary may be subject to additional fees or charges, and availability cannot be guaranteed.
C. Service Provider Cancellations: In the event of a cancellation by a third-party service provider (e.g., airline, hotel), the Company will make reasonable efforts to notify you and assist you in making alternative arrangements. The Company is NOT responsible for any costs or losses incurred due to service provider cancellations.
6. Liability
The Company acts as an intermediary between clients and third-party travel service providers, such as airlines, hotels, and tour operators. We are not responsible for any errors, omissions, acts, or failures of these third-party providers. Our liability is limited to the extent permitted by law.
7. Privacy
We respect your privacy and will handle your personal information in accordance with our Private Policy, which can be found on our website in the section below this one.
8. Termination
The Company reserves the right to terminate or suspend your access to our services or website at any time, with or without notice, for any reason, including but not limited to a violation of these Terms and Conditions and/or Private Policy.
9. Governing Laws
These ‘Terms and Conditions’ are governed by the laws of the State of New York, and any disputes arising from or related to these “Terms and Conditions” shall be subject to the exclusive jurisdiction of the state and federal courts located within the state of New York.
